Doctors will examine the 85-year-old man suspected of shooting and killing his sleeping grandson to learn more about his mental state, according to his lawyer.
John Watkins told Antioch police he killed his grandson, 30-year-old Ben Phillips, on Aug. 12 because Phillips had repeatedly threatened him and his wife.
"(Watkins) stated he was scared and threatened by the victim, and that he felt he had no choice but to kill the victim as he slept," Watkins' arrest warrant said.
Police at the scene said Watkins might have been taking medication for memory loss, but his lawyer Scott Wilder said family had not yet confirmed that.
"They're still in the process of doing the grieving," he said.
The evaluation will include an examination of all of Watkins' medications. Wilder said he will ask to postpone a preliminary hearing scheduled for today until the evaluation can be completed.
