CHATTANOOGA, Tenn. (AP) -- A Hamilton County judge is reviewing transcripts of divorce proceedings of U.S. Rep. Scott DesJarlais to decide whether sealed records should be released to the public before Tuesday's election.

DesJarlais, a freshman Republican whose re-election platform includes his opposition to abortion rights, has been under fire since a transcript emerged of a phone conversation in which he urged a mistress to seek an abortion.

The congressman has said he was only using strong language to get the woman to admit she wasn't pregnant, and that both he and his first wife, Susan, were seeing other people while their 2001 divorce was being finalized.

Gerard Stranch, a Tennessee Democratic Party attorney who filed the motion, said he expects a decision from Judge Jacqueline Bolton later in the day.
