A trial for the former student accused of killing a Campbell County assistant principal in 2005 will go forward after a judge denied an appeal by the state.
Kenneth Bartley pleaded guilty in 2007 to charges tied to the shooting that left Assistant Principal Ken Bruce dead, and two other administrators injured at Campbell County High School. But his attorney says the teen didn't have enough time to consider his options, and Judge Jon Kerry Blackwood agreed Bartley should get a new trial.
The state appealed that ruling, but in a filing Monday, an appeals court agreed with Judge Blackwood. The appeals judge blames Bartley's attorneys, saying they didn't counsel him effectively enough.
