A German family living in Morristown is denied asylum in the United States.
The Romeike family came to the US from Germany in 2008, after they say they were criminally prosecuted for homeschooling their children.
A judge granted them asylum in 2010, but the decision was over turned by the Board of Immigration Appeals in 2012.
The Sixth Circuit Court of Appeals ruled to uphold the appeal this week.
The court said that the Romeikes had not made a sufficient case that persecution related to homeschooling fits within the US laws on asylum.
The Home School Legal Defense Association is appealing the ruling.
